2. Who are we?
We are Global Villaje Radio.
Global Villaje Radio CIC is an internet radio outlet which is the main data controller for your personal information. This Privacy Policy explains how we collect and use information about you when you interact with our brand, app and this website.
Our services sometimes link to services or advertisements run by other companies (for example, when you click on an online advertisement on our website). These take you away from Global Villaje Radio website or brand app, and these companies have their own privacy and cookie policies. We have no control over the content or privacy practices of those other platforms and the information you give them will follow their policies and rules and not ours. We advise you to check their privacy policies before providing your information to them.
3. What personal information do we collect from you?
The information we may collect about you will vary depending on how you interact and engage with us. It may include the following:
a. General identification and contact information
We may collect and process your name, address, phone number, email address, IP address, username, password, age, gender and date of birth when you provide them to us, for example, when you:
• register to listen to our radio station
• visit our website
• enter a competition
• sign up on our join the conversation page
We will combine the information we collect about you so that we can tailor our communications with you, serve you age appropriate content you find relevant and engaging and serve you relevant adverts, if you have given us consent to do so. You can manage your advertising preferences through our Privacy Manager.
b. Financial information
We may collect your name, bank account and sort code, for example, to transfer to you a cash prize you have won in one of our competitions.
c. Device information
We may collect some technical information from your devices (for example, computer, mobile, TV, tablet, speaker or other voice-enabled devices) and web browsers. This might include the IP address and Device ID attached to your device. This enables us to serve you personalised adverts, recommend content and understand when you have made repeated visits to our websites and used our services.
We will not collect your Device ID and will anonymise your IP address if you have not consented to the use of them through our Privacy Manager.
d. Usage Information
We may collect information about how you have engaged with our services or programmes, such as the types of articles being read and the stations, programmes and podcasts being listened to.
e. Information if you communicate with our station or website
If you call, text, email or otherwise communicate with us, we may collect your name, location and a brief summary of your contribution or opinion. We may use your phone number to invite you for further discussion about a topic on one of our shows. Please note, some of this information may include sensitive information when you provide that information to us as set out in section h. below.
f. Location information
When you register on Global Villaje Radio account, we ask what country you’re in so we can comply with the relevant copyright rules according to the country you are in. We also ask for your postcode so we can serve you localised content, such as news and weather.
We will only collect information regarding your geographic location based on your full IP address and the GPS of your mobile device, if you have consented through our Privacy Manager.
If you have not consented to the use of your full IP address, our ad serving systems may still make estimations on your general local area when you view or listen to content  on Global Villaje Radio (for example, the country, town or county you are likely to be in) using your anonymised IP address and serve you podcast adverts based on those estimations. We will not be able to identify your precise location through an anonymised IP address.
To monitor and understand what people are saying about Global Villaje Radio and our services on social media, we collect information about comments or other information you may have made publicly available about us. For example, comments made on social media platforms such as Twitter or Facebook. If you use your social media accounts to directly engage us (such as including one of our Twitter handles in a public message or direct messaging us), we may also use your username or Twitter handle in order to correspond with you and to track interactions we have had with our listeners on social media.
h. Sensitive information
We will only collect sensitive personal information (also known as ‘special category personal data’) from you if you provide us with it. Sensitive personal information includes information about your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, sex life or sexual orientation.
For example, you may provide us your political opinions to discuss on one of our shows or submit other sensitive personal information if you choose to participate in our surveys.
Please do not submit such sensitive information if you do not wish us to process it.
4. What information do we collect about you from other sources?
We may obtain additional information about you from trusted third parties and public sources:
a. to assist us in our marketing, including Online Behavioural Advertising (“OBA”) (also known as “personalised advertising”), and to ensure that you receive adverts and other information that is relevant to you. For example, you may have entered a competition or completed a survey or questionnaire on a third party website and agreed that this data may be shared with others parties.
Alternatively, you may have consented to a third party placing cookies on your device and sharing this information with Global Villaje Radio . We make sure to use reputable third party providers and take steps to ensure that our providers respect your privacy rights.
Information provided to us in this way may include details about your demographics, interests and other classifications such as gender, age bracket, social grade or hobbies according to your browsing interests. We then use this information to place you in particular groups or segments with other users with similar information (a process known as ‘profiling’ or ‘segmenting’) and may combine this information with other information we hold about you (such as general information, device information and usage information described in section 3 above) or information we have collected when you signed up as a VIP, so that we can deliver advertising that is relevant based on your interests. For example, if you have been clicking on articles about our music or listening to our radio station which plays primarily vintage soul and R&B music, we may combine this information to learn you have an interest in soul and R&B music and, as a result, you may be shown more adverts for music events. You can manage personalised advertising settings through our Privacy Manager.
b. If you log in via Facebook or Twitter you will be giving Facebook and Twitter permission to share some of your details with us depending on your privacy settings on their site. For example, if your Facebook privacy settings are set to allow it, they will provide us with your public profile which includes your name, email address and profile picture.
5. How do we use your Personal Information?
We have to have a valid reason to use your personal information. This is called a “lawful basis for processing”. We process personal information under the following legal bases:
a. Consent
We use your personal information where you have given us your consent. We rely on your consent for the following:
• to email you about products, events, services and promotions that we or our third-party partners are offering
• to send you notifications on your device
• to provide personalised messages and content if you are a member of our VIP programme
• to collect personal information about you through the use of non-essential cookies to deliver personalised advertising
When we process personal information based on your consent, you have the right to withdraw consent at any time and we will cease to process data after consent is withdrawn.

If you would like to withdraw your consent to receive personalised advertising and content through the use of cookies, you can manage your cookie consent using our Privacy Manager.

b. The processing is necessary to fulfil a contract
We may process your personal information when we need to fulfil a contract with you. For example, when you enter a competition on our website and provide us with personal information, we will need to use this personal information to contact you should you win.
c. Legitimate Interest
We process your personal information when we have a legitimate interest to do so, provided that our interests are not overridden by your data protection rights.
Our legitimate interests include where we use your personal information to:
• improve or tailor our content, products, services and customer experiences by monitoring your use of our services and working with our suppliers to improve the products and services we offer, develop new content and services
• meet our regulatory requirements by delivering age appropriate content
• text you information about products, events, services and promotions that are similar to any you have received or bought from us (unless you have opted out to hear from us)
• ensure the security and integrity of our services
• ensure that our websites and apps operate effectively
• protect customers and other individuals, for example, from abuse and harassment and to maintain their safety, health and welfare
• carry out market research
• deal with your requests, complaints and enquiries. For example, to answer your questions or to respond to a comment or complaint
d. Necessary to comply with a legal and regulatory obligations
We may process your personal information to comply with our legal and regulatory obligations for example, preventing, investigating and detecting crime, fraud or anti-social behaviour and complying with law enforcement agencies.
6. Who do we share your personal information with?
a. Our group companies
We may share your personal information with certain of our group companies. Where they have access to your personal information, they will use it only for the purposes set out in this Privacy Policy.
b. Partners
If you sign up for one of our services which we offer with a third-party partner, you will be providing your information directly to our third-party partner. We advise that you check their privacy policy or statement to understand how they use your information before you share any information. Their privacy policy or statement should also explain whether they may share certain information with us. If they do, we will only use that information for the reasons set out in this policy.
c. Sponsors
If you enter a competition we may, if you have agreed, disclose your information to the competition sponsors. If you are a prize winner, we will give your information to the sponsors and share your information with the parties who assist us in providing prizes to the winners.
We may carry out research or analysis, which contains your personal information, via our websites, and share aggregated responses to questions with our partner organisations.
d. Our service providers
We may share your personal information with our external third-party service providers. These include healthcare practitioners, accountants, auditors, lawyers, other professional advisors, IT systems, support and hosting service providers, printing, market research and analysis service providers, website analytics, technical engineers, data storage, cloud providers, outsourced service providers and other similar third-party vendors that assist us in carrying out business activities.
e. Government authorities and related third parties
We may need to share your personal information with Government bodies, law enforcement agencies or other regulatory bodies agencies where we are required to do so or where necessary to enforce our rights.
f. Online Behavioural Advertising (OBA)
If you have consented to the placement of non-essential cookies when visiting our websites and using our apps, we will share the personal information we collect via such cookies with third parties such as:
• potential advertisers who want to deliver their adverts to a particular audience and with agencies acting on their behalf. This will include information about particular segments that we have categorised you in, based on the information we hold about you; and
• other third parties who receive limited amounts of information (such as online identifiers) in order to assess whether you have seen an advertisement and whether you took any action based on that advertisement (such as clicking on a link).
When we share your personal information in this way, we ask the recipients to only use your information where necessary in order to choose whether to use our OBA services. However, we cannot control the use these advertisers and agencies will make of your personal information once it is received. For further information about how they may use your personal information, we’d recommend reviewing the privacy information provided by the third parties you have given your consent via the Privacy Manager for us to share your data with.
In addition, if you have registered with Global Villaje Radio  via one of our apps or websites, your user ID will be shared and matched with our insight tools to inform more relevant targeting of audio, video and display advertisements. This includes Nielsen Marketing Cloud, a data management platform which is used to select relevant advertising based on your online behaviour.
You can give and withdraw consent and control which third parties will receive your personal information for OBA purposes via our Privacy Manager.
g. When you use a device such as a smart speaker
You can access our services through voice-enabled devices, such as an Amazon Alexa or other smart speakers. You will be able to link your smart speaker account with your Global Villaje Radio  account. Once linked, and provided you have agreed to receive personalised advertising from us (as explained above), you may also receive such advertising via our audio streams when you select them on your smart speaker. The company that provides your smart speaker service shares with us an identifier (being a string of characters) with us to enable us to do this, but does not share any other personal data of yours with us and we do not share information we hold about you with your Smart Speaker providers.
You can choose not to receive personalised adverts at any time by turning this option off in your Privacy Manager.
We are not responsible for how your smart speaker collects and uses your personal information, except as described above but you can find out more about how your provider uses your personal information by checking their privacy policy.
7. How long do we keep your information for?
We hold personal information for different purposes and the length of time we keep your information will vary depending on the services or products we are providing. We will only keep your data for a reasonable period of time, which is based on the purpose for which we are using your data. Once that purpose has been fulfilled, we will securely delete that data or anonymise your information (so that we, or anyone else, can no longer tell that data relates to you) unless we are required to retain the data longer for legal, tax or accounting reasons.
To determine the period we store personal information, we always stick to these principles:
• we will only keep your information for as long as we need to, and
• we think about what type of information it is, the amount collected, how sensitive or intrusive it might be and any legal requirements.

8. International Transfers of Personal Information
Personal information which you supply to us is generally stored and kept inside the UK.
However, due to the nature of our business and the technologies required, your personal information may be transferred to certain third-party service providers in countries outside the UK. These countries (including the United States) may not have the same data protection laws and may offer a lower level of protection.
If we do need to transfer your personal information in this way we take steps to ensure your level of privacy including data minimisation, anonymising or pseudonymising data, encryption, undertaking due diligence on the recipients and putting in place contractual obligations on them to take care of your data, for example by using approved model clauses. 9. Where to find the Privacy Manager
When you first visit our site or download our apps or after you have deleted our cookies from your device, you will be presented with the Privacy Manager pop up. You can also find the Privacy Manager link at the bottom of all our brand webpages or in the “settings” on our apps, including Global Player. 10. Your rights in relation to how we use your personal information.
Data Protection laws give you certain rights in respect of your personal information. Please contact us using the contact details below if you wish to exercise any of your data rights.
You have the following rights:
· Right to be Informed
You have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we’re providing you with the information in this Privacy Policy.
· Right to rectification
The right to have your personal information corrected if it is inaccurate or incomplete. You can also correct personal information yourself if you have registered with us via an account on one or more of our websites.
· Right of access
You have the right to obtain a copy of your personal information and certain other information about the processing we undertake (similar to the information set out in this Privacy Policy). This is referred to as a data subject access request.
· Right of erasure
The right of erasure (also known as the ‘right to be forgotten’) allows you to request the deletion or removal of your personal information where there is no compelling reason for us to continue processing it. This right is not absolute, and there are circumstances where we may need to continue processing your data despite a request for erasure.
· Right to object and opt-out of marketing
You have the right to object to certain types of processing of your personal information. This includes the right to object to direct marketing. You can exercise your right to opt-out of further direct marketing when you receive such communications from us (via the ‘unsubscribe’ option we include in each email or you can contact us directly.
· Right to portability
You have the right to receive certain personal information from us in a commonly used electronic format (such as an excel file) so that this personal information can be used in a different service.
· Right to restrict processing
You have the right to restrict or ‘block’ the use of your information in certain circumstances such as when you think your data rights outweigh our legitimate interests in the processing. When you exercise this right, we can still store your information but cannot undertake further processing.
· The right to withdraw consent
If you have given your consent to anything we do with your personal information, you have the right to withdraw your consent at any time (although if you do so, it does not mean that anything we have done with your personal information with your consent up to that point is unlawful).

We aim to respond within one month of receiving your request or identifying information (if required), and we will let you know if we anticipate your request taking any longer.
While we usually act on requests, we can refuse to do so (or may charge a reasonable fee to cover our administrative expenses) where you make baseless, excessive or repeated requests or ask us for further copies of information we have already provided.

By accessing this website owned, controlled, maintained or operated by Global Villaje Radio and/or by registering with the website you are agreeing to comply with the terms and conditions set out below (which shall include the privacy policy and the Competition terms and conditions (if applicable)) (“Terms”), whether or not you register to use the Site.

1.    Introduction and About Us
The Sites are owned and operated by Global Villaje Radio CIC registered in England and under number 13276352 with its registered office at 24 Princes Avenue, Watford, WD18 7RS
2.    Access to the Sites
Access to the Site is permitted on a temporary basis and Global Villaje Radio reserves the right to withdraw the website (in whole or in part) or amend any part of them (including but not limited to content and materials on the website and any services made available through them).  Please also see Section 5 below.
Global Villaje Radio shall not be liable if for any reason the website is unavailable at any time or for any period. You may only use our website or the software and services available through them (including but not limited to the Content and User Generated Content as defined below) (collectively, the “website services”) for lawful purposes.
You must not use our website or the website services:-
(i)    in any way that breaches any applicable local, national or international law or regulation;
(ii)    in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect or promotes such purposes;
(iii)    for the purpose of harming or attempting to harm minors in any way;
(iv)    to send, knowingly receive, upload, download, use or re-use any material which is in breach of Section 5 of these Terms; or
(v)    to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (“Spam”). You are responsible for making any arrangements necessary for you to have access to the Sites.
You are also responsible for ensuring that any persons who access the Sites through your internet connection are aware of these Terms and comply with them.
3.    Use of Content and linking to the Sites
All content and material on the Sites (but for the avoidance of doubt excluding User Generated Content) (the "Content") belongs to Global Villaje Radio, or its licensors, and save where otherwise specified users should assume that all Content is owned by Global Villaje Radio. The Content is protected by copyright laws around the world. Unless expressly stated, no Content may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, and may only be used for your personal, non-commercial use.  Modification of the Content or other prohibited use of the Content is a violation of Global Villaje Radio copyright and other proprietary rights. All trademarks, service marks and trade names on the website are proprietary to Global Villaje Radio or its licensors.

In particular, but without limiting the above restrictions, you may not do any of the following without prior written permission from Global Villaje Radio
(i)    redistribute any of the Content (including by using it as part of any library, archive or similar service);
(ii)    remove any copyright or trade mark notice from the Content; or
(iii)    create a database in electronic or structured manual form by downloading and storing all or any of the Content.
You may not create any link from or to our website without Global Villaje Radio’s prior written consent.  Please contact us if you wish to request permission to link to our website.
4.    Registration
As a user, you will be able to access material on most areas of the website without going through the registration process.  However, we may restrict access to certain areas of the Sites (e.g. the Forums - see Section 5 below) and you may need to register with us to access such areas.

On registration, you must provide Global Villaje Radio with accurate, complete registration information and it is your responsibility to inform Global of any changes to that information (including in particular your e-mail address) by using the edit details function available on the Sites with which you are registered. Each registration is for a single user only. On registration, you should choose a user name and password. You should treat your user name and password as confidential. You warrant that you will not impersonate another individual when using the Sites or the Site Services.
Global Villaje Radio does not permit any of the following:-

(i)    any other person sharing your user name and password; or
(ii)    access through a single name and password being made available to multiple users on a network.
You are responsible for, and will be liable to Global Villaje Radio for, all use of the Sites made by you or anyone else using your user name and password (collectively, "ID") and for preventing unauthorised use of your ID. If you believe there has been any breach of security (e.g. the disclosure, theft or unauthorised use of your ID or any payment information), you must notify Global Villaje Radio immediately at our contact us page.  Global Villaje Radio will not be liable to you or any third party for unauthorised use of your ID.
You must not use the service to send, or use or re-use any material which is un-lawful, threatening, abusive, libellous or indecent or which infringes copyright or other rights of third parties or which contains any other form of illegal content.  You must not use such service or any other website services to send any chain e-mails or Spam.
5.    Community Forums and Posting Content to the Sites
The website include chat rooms, bulletin boards, discussion groups and other public areas that allow you to interact with other users and Global Villaje Radio (“Forums”) and to post/transmit/upload (“Post”) content to the website (“User Generated Content”) including without limitation your review of any gig you attend, album reviews, personal blogs and your personal gallery.
Where we do provide a Forum, we will provide clear information to you about the nature of the service being offered.  Global Villaje Radio reserves the rights in its absolute discretion to cease the provision of any or all Forums without notice to you.
As mentioned above, Global Villaje Radio (who will be clearly identified as such) will also contribute material to the Forums in order to stimulate discussions and ensure the smooth running of the Forums. The Forums may also contain User Generated Content from special guests selected by Global Villaje Radio. The opinions of Global Villaje Radio and special guests are their own and are not necessarily endorsed by Global Villaje Radio. They should not be considered by you as professional advisers and any comments they make are not intended to amount to advice on which reliance should be placed.
You will need to be registered as a user (unless otherwise stated) in order to Post User Generated Content.  You are solely responsible for any material and information forming your User Generated Content.
By Posting User Generated Content you warrant and agree that :-
(i)    you are 18 years of age or older or are aged 14 - 18 and have received consent from your parent or guardian for you to use such Forums;
(ii)    that you will comply with any additional rules posted by Global Villaje Radio on a Forum;
(iii)    you own or are licensed in respect of the User Generated Content Posted and that you have the right, power and authority to grant the rights set out in these Terms;
(iv)    that Global Villaje Radio is free and able to use User Generated Content in accordance with and in the manner set out in these Terms without any payment (including any royalty payments to third parties) and that in particular Global may lawfully permit other users to view the User Generated Content;
(v)    have obtained all consents, releases and permissions (including of each person identifiable) in respect of the User Generated Content; and in addition you warrant and agree that such User Generated Content:
(vi)    is accurate (where facts are stated) or if an opinion is stated that such opinion is genuinely held;
(vii)    is not confidential and does not infringe the intellectual property, privacy or any other rights of any third party, and does not contain anything which is unlawful, abusive, libellous, defamatory, obscene, indecent, harassing or threatening;
(ix)    is not copyrighted  or alternatively that you own the copyright or have the necessary permissions and rights to use it;
(x)    is not discriminatory or does not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
(xi)    is not sexually explicit, obscene or pornographic and does not promote violence;
(xii)    such User Generated Content does not solicit personal information for any users under 18 years of age;
(xiii)    does not include telephone numbers, physical addresses, email addresses or last names or other personally identifiable information; (xiv)    does not violate any applicable law or regulation;
(xv)    does not, to the best of your knowledge, contain a virus or other harmful component or computer programming routines, software, files or code designed to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
(xvi)    does not interrupt, destroy or limit the functionality of the Site(s) or any computer software or equipment;
(xvii)    does not disguise the origin of any User Generated Content or impersonate any person or entity or misrepresent any affiliation with any person or entity or collect or store other users' personal data;
(xviii)    does not, or is not likely to, harass, upset, embarrass, alarm or annoy another person; and
(xix)    does not give the impression that it emanates from a third party (including Global Villaje Radio if that is not the case.
You warrant and undertake that you will not:
(i)    Post, link to or otherwise publish commercial material or material that promotes any commercial activities or contains recommendations to buy or refrain from buying a particular item (and in particular shares) or which contain confidential information of another party or which otherwise have the purpose of affecting the price or value of any item (and in particular shares); or
(ii)    Post or otherwise publish any User Generated Content unrelated to the Forum or the Forum's topic.
By Posting User Generated Content you hereby grant a perpetual, royalty-free, worldwide, non-exclusive licence to Global Villaje Radio to use, reproduce, modify, translate, make available, distribute, publish and/or perform the User Generated Content and to distribute and/or broadcast such User Generated Content in whole or in part in all media and in all formats (including transmission by way of analogue transmission, digital audio broadcasting, internet, satellite, television, film, cable or telephony) and to sub-license any other persons to do so, in each case for such purposes as Global Villaje Radio may in its reasonable discretion determine.  Please note that you can terminate the licence granted under this paragraph by removing the User Generated Content from the Site and emailing us at our contact us page with full details of all User Generated Content that you wish to be removed.  Global will endeavour to remove the User Generated Content from the Site within 28 days. In addition, you agree to waive any moral rights you may have in the User Generated Content and that you have obtained a waiver of all applicable moral rights in the User Generated Content.
By submitting User Generated Content to the Site(s) you agree to indemnify and hold harmless Global Villaje Radio  from all claims, costs, liabilities and expenses (including legal expenses) suffered by Global Villaje Radio arising out of any User Generated Content Posted by you that is in breach of these Terms.

Some users may breach these terms and post User Generated Content that is misleading, untrue or offensive. You accept to bear all risk associated with your use of the Forums and should not rely on User Generated Content in making (or refraining from making) any decisions. You agree that to the fullest extent permitted by law Global Villaje Radio shall not be liable to you in respect of any User Generated Content you view via this Site.
Whilst Global Villaje Radio does not control or monitor the User Generated Content posted to Forums by users, it reserves the right (which it may exercise at its sole discretion without notice) to commence such monitoring (whether by human moderation or technical methods) or to delete, move or edit any User Generated Content. Global Villaje Radio reserves the right to contact you by e-mail with regard to your use of the Forums.
6.    Reporting offensive/illegal content
Whilst Global Villaje Radio does not control or monitor the User Generated Content posted to Forums by users, we do not wish to see harmful, offensive or illegal content on our Sites.  If you have any concerns about any Content or User Generated Content that appears on our Site or you believe that such Content or User Generated Content is harmful, offensive or infringes your rights (including without limitation your intellectual property rights), please contact us at our contact us page with the following information in sufficient detail:-
(i)    the location of the harmful/infringing/offensive content on our Site(s);
(ii)    a brief description of why you consider the content to be harmful, offensive or infringing and a statement confirming that you have a reasonable and honestly held belief that use of the content is not authorised;
(iii)    a brief description of, and information related to, the copyright work which you believe is infringed; and
(iv)    your contact details.
We will remove any and all Content and User Generated Content (without prior notice to you) if we reasonably believe such Content/User Generated Content to be in breach of these Terms.
7.    Suspension and termination of registration/access to Forums
Global Villaje Radio will determine in its discretion whether there has been a breach of these Terms through your use of our Site(s).  When a breach of these Terms has occurred, we may take such action as we deem appropriate.
Failure to comply with these Terms may result in our taking all or any of the following actions:
(i)    immediate, temporary or permanent withdrawal of your right to use our Sites (including our Forums);
(ii)    immediate, temporary or permanent removal of any User Generated Content posted by you to our Site(s);
(iii)    issue of a warning to you;
(iv)    legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
(v)    further legal action against you;
(vi)    disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
We exclude liability for actions taken in response to breaches of these Terms.  The responses described in this Section 7 are not limited, and we may take any other action we reasonably deem appropriate.
8.    News by E-Mail
Global Villaje Radio may give you the option to subscribe to its e-mail news service. Your use of any information received through the e-mail news service will be subject to these terms.
9.    Viruses, hacking and other offences
You must not misuse our Sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.  You must not attempt to gain unauthorised access to our website, the server on which any of our Sites are stored or any server, computer or database connected to or on our Sites.  You must not attack our website via a denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990.  We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.  In the event of such a breach, your right to use our websites will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Sites or to your downloading of any material Posted on it, or on any website linked to them.

Global Villaje Radio is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites.   In particular, if you use links from the Sites to an authorised connected site not operated by Global Villaje Radio to download software from the website or any other material, files, images or data, you acknowledge and agree that Global Villaje Radio has no responsibility or liability in connection therewith, and does not transfer title to you.

The Content and any User Generated Content is for your general information and use only and is not intended to address your particular requirements. Whilst Global Villaje Radio aims to update the website regularly, any of the Content or User Generated Content may be out of date and Global Villaje Radio assumes no responsibility for updating this. Part of the website may contain advertising and sponsorship.  Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Sites complies with applicable law and regulation.  Global Villaje Radio will not be responsible for any error or inaccuracy in advertising material.
16.    Choice of law & jurisdiction
These Terms shall be governed by, and construed in accordance with, English Law. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. 
17.    Third Party Copyright
Some of the content used on our website(s) (such as, but not limited to, images and/or audio-visual material) are copyrighted works which belong to and are supplied by third parties who reserve all their rights in such content. All such third parties shall be entitled to enter the benefit of these Terms in respect of their content as if they were Global Villaje Radio herein and shall be bound accordingly.
18.    General
You may not assign, sub-license or otherwise transfer any of the rights under these Terms.  If any term is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.  Failure by either party to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. Headings in these terms are for convenience only and will have no legal meaning or effect.
